Matthew Hickey appeared for the successful respondent, the Chief Executive, in resisting an application for a statement of reasons for a decision made under s 295 of the Environmental Protection Act 1994 (Qld), which determined the amount and form of financial assurance required to be provided by the operator of the Blair Athol coal mine.
The application had been brought by an environmental organisation. Bowskill J dismissed the application on the basis that the applicant was not a person whose interests were adversely affected by the decision, and were therefore not entitled to a statement of reasons.
