The proceedings involved two appeals ordered to be heard together and concerned competing applications for a shopping centre. In one appeal the appellants appealed the council’s decision to grant the co-respondent’s a development permit for a material change of use to facilitate a local centre. In the other appeal the appellants appealed the council’s decision to refuse their own application for a preliminary approval for a material change of use to facilitate a local centre. This judgment determined a number of interlocutory matters, including a contested minor change application application. The matter is ongoing.
