This was an appeal against deemed refusal of a development application for an integrated waste facility. The Council, supported by the co-respondent by election, contended that the development application should be refused on the basis on alleged non-compliance with several planning documents. Central to the allegation was a contention that the proposed development was inappropriate in terms of its environmental and amenity performance.
