Mr Harding was a candidate for the position of Lord Mayor on the Brisbane City Council. He sought an injunction against the incumbent Lord Mayor Mr Quirk and his party colleagues to restrain the distribution of a pamphlet on Council election day which it claimed constituted an unauthorised how-to-vote card. The Court resolved the question with reference to the interpretation of the Local Government Electoral Act 2011 (Qld) and determined that the leaflet was not an unauthorised how-to-vote card. The application for injunction was refused.
