Under the Guardianship and Administration Act 2000 (Qld), the respondent was appointed the administrator of certain aspects of the estate of the deceased Mr Clark. The Public Trustee of Queensland was appointed as the administrator for the remainder of Mr Clark’s financial matters. Mr Oldmeadow, as administrator of Mr Clark’s estate, wished to prosecute the respondent for inappropriate conduct regarding certain actions in relation to particular aspects of Mr Clark’s estate.
Proceedings were commenced in November 2019 by originating application, but the return date was adjourned 21 times as the respondent was not served until July 2022. The substance of the proceeding concerned leave to extend time pursuant to rule 7 of the Uniform Civil Procedure Rules 1999 (Qld) (UCPR) to comply with a guillotine order and leave to proceed pursuant to rule 389 of the UCPR.
