The Federal Court (Button J) heard an application to stay proceedings brought by Clive Palmer and one of his companies.
In the proceedings, the Palmer Parties sought declarations as to the validity of interviews of Mr Palmer, conducted by ASIC under compulsory powers, and the use of transcripts produced in consequence of them.
ASIC and the Commonwealth Director of Public Prosecutions applied to stay the proceedings because it constituted an impermissible fragmentation of an ongoing criminal prosecution against Mr Palmer and his company in the Magistrates Court of Queensland.
Button J stayed the Palmer proceedings until those criminal prosecutions are determined.
Matthew Hickey and Salwa Marsh appeared for the CDPP, instructed by the Australian Government Solicitor.
