PresCare is a ministry division of the Presbyterian Church of Queensland (“Church”). It is responsible for the operation of aged care facilities. The Presbyterian Church of Queensland Incorporated by Letters Patent (“PCQ”) holds much of the property of the Church, and it is the trustee of a charitable trust (or charitable trusts). The receivers of the assets, property, and undertaking of PCQ sought directions in relation to the sale of three aged care facilities. Brown J directed that the receivers were justified in completing the sale.
